The European General Data Protection Regulation (GDPR) refers to the Charter of Fundamental Rights of the European Union.
Recital 1 of the GDPR reads:
The protection of natural persons in relation to the processing of personal data is a fundamental right. 2Article 8 of the Charter of Fundamental Rights of the European Union (the ‘Charter’) and Article 16 of the Treaty on the Functioning of the European Union (TFEU) provide that everyone has the right to the protection of personal data concerning him or her.
The Charter of Fundamental Rights of the European Union defines the rights and freedoms of people living in the European Union in a clear and concise manner.
Art. 8 - Protection of personal data
The protection of one's own personal data is therefore a fundamental right of every person in the European Union. When and to what extent personal data may be processed is specified in more detail in the European General Data Protection Regulation (GDPR).
