Article 9 of the GDPR refers to "special categories of personal data". The processing of these categories of data is initially prohibited.
Processing of personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation shall be prohibited.
The processing of personal data falling into these categories is only possible under certain circumstances and under strict conditions. Processing should only take place in exceptional cases.
These requirements must be taken very seriously, as the national supervisory authorities scrutinise these cases more closely and can impose higher fines.
