Rights of use and copyright

When using image and video material, also pay attention to copyright and usage rights. Although this is not a data protection issue, penalties can also be imposed here.


Copyright and right of use
Anyone who takes a photo is its author and therefore holds the copyright to this photo. If other people want to use this photo, the author can transfer the right of use to them. This authorises the person to use and publish the photo. You can purchase rights of use from large image databases, for example. There you do not buy the photos themselves, but acquire the right of use. The copyright always remains with the photographer.


Right to one's own image

If people are depicted in the photo, they have a "right to their own image". This means that the photo may not be published without their consent. Be sure to observe national case law in this regard.

If you take photos yourself at an event and have obtained the consent of the persons depicted, you can use the photo without any problems. If you take a photo from an image database, you must trust that the photographer has the consent of the persons depicted.
